Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "you", or "your") and Luminary Tours LLC ("Luminary Tours", "we", "our", or "us"), a limited liability company registered in the United States.
By accessing our website at luminarytours.com or booking any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
2. Services
Luminary Tours provides premium private tour experiences, transportation services, and travel consulting across multiple destinations including Japan, South Korea, Morocco, Egypt, and Brazil. Specific service offerings, availability, and pricing are detailed on our destination pages and confirmed in your booking documentation.
We reserve the right to modify, suspend, or discontinue any service at any time without prior notice. We will make reasonable efforts to communicate changes to clients with existing bookings.
3. Booking & Payment
All bookings are subject to availability and confirmed only upon receipt of full or agreed partial payment. A booking confirmation email constitutes the formation of a contract between you and Luminary Tours LLC.
- Deposit: A non-refundable deposit may be required at the time of booking, as specified in your tour quote.
- Balance: The remaining balance is due no later than 30 days prior to the tour departure date, unless otherwise agreed in writing.
- Currency: All prices are quoted in United States Dollars (USD) unless otherwise stated.
- Payment processing: Payments are processed securely through Stripe. By providing payment information, you authorize Luminary Tours to charge the applicable fees.
4. Cancellation & Refund Policy
We understand that travel plans may change. The following cancellation policy applies to all bookings:
- 60+ days before departure: Full refund of amounts paid, minus any non-refundable deposit.
- 30–59 days before departure: 50% refund of the total booking value.
- 15–29 days before departure: 25% refund of the total booking value.
- 14 days or fewer before departure: No refund. The full booking amount is forfeited.
Cancellation requests must be submitted in writing to hello@luminarytours.com. The cancellation date is the date on which we receive your written request.
We strongly recommend purchasing comprehensive travel insurance to cover cancellations, medical emergencies, and other unforeseen circumstances.
5. Changes to Bookings
Requests to change booking dates, itineraries, or group sizes must be submitted in writing at least 21 days before the tour departure date and are subject to availability. Amendment fees may apply. Changes within 21 days of departure may be treated as a cancellation and re-booking.
6. Cancellation by Luminary Tours
We reserve the right to cancel or alter a tour due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, extreme weather, or acts of God.
- Civil unrest, political instability, or government travel advisories.
- Pandemic or public health emergencies.
- Insufficient bookings to operate a viable tour.
In the event of cancellation by Luminary Tours, you will receive a full refund of all amounts paid, or the option to reschedule at no additional cost. We shall have no further liability to you.
7. Client Responsibilities
By booking with Luminary Tours, you agree to:
- Ensure that all members of your traveling party hold valid passports and any required visas for the destinations visited.
- Disclose any medical conditions, dietary requirements, or physical limitations that may affect your ability to participate in activities.
- Behave respectfully toward guides, local communities, and other service providers throughout your tour.
- Comply with all local laws, regulations, and customs of the countries you visit.
- Arrive on time for all scheduled activities and transportation.
- Obtain appropriate travel insurance covering medical emergencies, cancellations, and personal liability.
8. Limitation of Liability
Luminary Tours LLC acts as a tour operator and coordinator. We work with third-party suppliers including hotels, transportation providers, and local guides. While we carefully vet all partners, we are not liable for:
- Loss, damage, or injury caused by the acts or omissions of third-party service providers.
- Loss or damage to personal belongings during a tour.
- Delays, cancellations, or changes caused by factors outside our control (force majeure).
- Illness, injury, or death arising from participation in tour activities.
To the maximum extent permitted by applicable law, Luminary Tours' total liability to you shall not exceed the total amount paid by you for the specific booking giving rise to the claim.
In no event shall Luminary Tours be liable for any indirect, incidental, special, consequential, or punitive damages.
9. Indemnification
You agree to indemnify, defend, and hold harmless Luminary Tours LLC and its officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your breach of these Terms, your use of our services, or your violation of any law or the rights of a third party.
10. Intellectual Property
All content on the Luminary Tours website, including but not limited to text, images, logos, graphics, and design elements, is the property of Luminary Tours LLC or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.
You may not reproduce, distribute, modify, transmit, or create derivative works from any content on our website without our prior written consent. You may share links to our website for non-commercial purposes.
11. Website Use
You agree not to:
- Use the website for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to any part of the website or its related systems.
- Transmit any harmful, offensive, or disruptive content through our website or communication channels.
- Use automated tools to scrape, crawl, or extract data from our website without permission.
12. Privacy
Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Wyoming, USA, in accordance with the rules of the American Arbitration Association.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and any booking confirmation or service agreement, constitute the entire agreement between you and Luminary Tours LLC with respect to your use of our services and supersede all prior agreements and understandings.
16. Changes to These Terms
We reserve the right to update these Terms at any time. We will notify users of material changes by updating the effective date at the top of this page. Your continued use of our services after changes constitutes acceptance of the updated Terms.
